1. Provider
The service provider is Filipe Clemente, a sole trader (brand estou.ai), in Portugal, who can be contacted at hello@tibly.eu.
2. Scope
These terms govern use of tibly, online software for restaurants to create and publish a digital menu opened by QR code, NFC or a direct link.
The service is for business customers (restaurants and hospitality businesses), not for end consumers.
3. Account
The restaurant creates an account with accurate information and keeps the password confidential. Whoever manages the account must not share it in an abusive way.
4. Acceptable use
It is not allowed to use tibly for illegal content, to infringe third-party rights, or to try to access accounts or systems without permission.
5. Restaurant content
Text, prices, photos, allergens and the rest of the menu are the restaurant's content. The restaurant is solely responsible for the accuracy of that information, including allergen information. tibly provides the technical means of publication and does not check the content of each menu.
6. Availability
We try to keep the service available, but we do not guarantee uninterrupted operation. There may be interruptions for maintenance, network failures or causes outside our control.
7. Price and billing
The price is the price of the plan the restaurant subscribes to and the price stated on the invoice. These terms do not set a price list. If the public pricing page does not show plans, the fees agreed at signup apply. Payment follows the invoice we issue. Unless the invoice says otherwise, prices do not include VAT.
8. Liability
To the extent Portuguese law allows, tibly is not liable for lost profits or for decisions the restaurant's guests make based on the menu. Nothing in these terms limits liability that the law does not allow to be excluded.
9. Termination
The restaurant may stop using the service and ask for the account to be closed. The provider may suspend or close access in the case of a serious breach of these terms, non-payment, or unlawful use.
10. Law and courts
Portuguese law applies. The courts are the competent Portuguese courts, without prejudice to mandatory rules.
11. Complaints book and ADR
The electronic complaints book is available at https://www.livroreclamacoes.pt/Inicio/.
Consumer alternative dispute resolution (RAL) is for consumers. The list of RAL bodies is at https://www.consumidor.gov.pt/ral-mapa-e-lista-de-entidades. Because tibly is a B2B service, disputes with business customers follow the law and courts clause above.
